INTRODUCTION

This website www.hiqker.com and/or any part thereof ("Website") is owned by Junoo Commercial Tech Pvt. Ltd ("Site Owner"). For the purpose of these Terms of Use, the expression "User" shall mean any person (including a Registered User) who accesses or uses the Website and the expression 'Registered User' shall mean a User who has registered himself/herself with the Website for availing the services provided therein. The Site Owner hereby grants the User a non-exclusive, non-transferable, limited license to use the Website, subject to the unconditional acceptance of the terms of use governing this Website. The User hereby agrees to familiarize himself/herself with the Terms of Use as well as other terms and guidelines found throughout this Website and abide by them. If the User is dissatisfied with the Website or any portion thereof, or with any of these Terms of Use, the User's sole remedy is to discontinue using this Website.

The Website is deemed to be used by the User when it is accessed by the User by any means and/or when it is loaded and/or continues to be loaded in the temporary or permanent memory of the User's computer or a similar system or in the internet browser thereof. The Site Owner's own records of the use of the Website and transactions concluded therein, maintained through computer systems or otherwise shall be accepted as conclusive and binding for all purposes. The User's use of this Website may be terminated at any time by Site Owner at the sole and absolute discretion of the Site Owner, without any reason or notice being required to be given to the User.

The User understands and agrees that Site Owner is a NETWORK SERVICE PROVIDER and an INTERMEDIARY within the meaning of Sec. 79 of the Indian Information Technology Act, 2000 and that the Website merely provides hosting services to its Registered Users and viewing facilities to persons browsing / visiting the Website. All the information posted therein has been posted by Registered Users and is third party user generated content. The Site Owner neither initiates the transmission nor selects the sender and receiver of the transmission nor selects / modifies the information contained in the transmission. The Site Owner has no control over the third party user generated content and shall not be liable for such content.

Users Account and Registration Obligations
The User can view certain information on the Website without registering on the Website. However, certain other activities on the Website including but not limited to uploading information, posting comments, etc require the User to register on the Website. The User Shall be required to provide some personal information, when the User creates a Registered User Account, including the User's email address, which is used to protect the Registered User's account from unauthorized access.

If a User uses the Website, the User shall be responsible for maintaining the confidentiality of the User's ID and Password and for restricting access to User's computer, computer system and computer network. The User shall be responsible for all activities conducted under the User's ID.

The User agrees, inter alia, to:
Provide true, accurate, current and complete information about the User in the registration form required to be filled in to create a Registered User Account (such information being the "Registration Data")
Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If the User provides any information that is untrue, inaccurate, not current or incomplete, or if the Site Owner has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the Terms of use, the Site Owner has the right to indefinitely suspend or terminate the User's registration with the Website and refuse to provide the User with access to the Website.
Unless specifically agreed to by the Site Owner in writing, no content from this Website may be used, reproduced, transmitted, distributed or otherwise exploited in any way.
User agrees not to submit any property descriptions, photographs, financial, contact or other information contained in each Property's data to the Website unless the User has acquired received all necessary rights and authorizations from the owner of such property or the power of-attorney holder, including from the photographer and/or copyright owner of any photographs, to publish and advertise the said Property(s) on the Website.
The User shall disclose all material information in respect of all such property(s) submitted including the present status and nature of such property and shall also disclose whether the property is free from all encumbrances or not. The User in addition shall furnish a brief background of such property in respect of title, ownership and possession, Site Owner may also require the User to support his/her claims with respect to the status of the property with such documents as may be specified by it from time to time.
The User may further be required to substantiate his claims as to the nature and status of the property by swearing an affidavit stating the authenticity of the information/data so provided/displayed. Site Owner may, at its sole discretion but without any obligation to, search for such and remove properties that are alleged to have been submitted in violation of this provision. In addition, Site Owner may require additional evidence of compliance with this provision from Users who are alleged to have submitted Properties or other information/data in violation of these terms & conditions. Site Owner will, in its sole discretion, terminate the accounts of, and Site Owner may refuse service to, any User who repeatedly or intentionally violates this Agreement. Additionally, the User agrees to allow the Property listing, or any part of it, to be searched, displayed, accessed, downloaded, copied, and otherwise referred to by users of the Website.

Site Owner shall have the sole authority to choose the manner in which any Property will be searched, displayed, accessed, downloaded, copied, and otherwise used on the Website and Site Owner shall have the right to modify the property listing in the exercise of its rights under this Agreement. In addition to the terms aforementioned the User agrees:-
(a) to represent and warrant that all Properties and associated information provided by the User will be accurate;
(b) that the User will not permit the posting of a property on the Website under a name other than the name of a the owner or of real estate agent who has been duly authorized and engaged by the owner of the property in this regard.
Site Owner reserves, the right to remove without prior notice, all or any part of the content posted on the Website by the User. Site Owner accepts no responsibility for checking/verifying the accuracy of reports or data files submitted by the User. While Site Owner shall take all reasonable efforts for data backup and business resumption, the User will be solely responsible for retaining back-up copies of all information, photographs and other materials furnished/submitted to the Website.

IP Rights Related  

Users, (aka) Buyers , who are Buying/Renting Products/Services can never own any of the product developed , unless the a detailed report on requirement regarding the Architechture and Stack and Flow is provided and with a requirement note of Source code on the Purchase Order or Communicating through the Sale order is neccessary . Or As a general Policy the product shall belong to the Company which has all the rights to sell , Resell, Distribute , Modify or make any changes according to the will of the Company . And will only offer Labeling or Licencing of the product , which shall be priced accordingly . If IP rights or Source Code is required , it has to be consulted before Making Payments as it may alter the Payment Structure .Failing upon which the Purchaser has 1 additonal month considering as lead time ,post full settlement of the due amount,to request for the Source Code or IP rights , which will incur Non-Negotiable addional Charges , which will be disclosed during the time of request .

Developement Services Terminated during the process shall attract the full payment of the agreed Sale Amount . 

Users, who are buying/renting property/properties through the Website, must verify/confirm details of the property/properties as well as its right, title, ownership, lien etc. on their own. Site Owner will not be responsible for the title or deeds of the property buying/renting through the Website The User understands and acknowledges that the Website is intended to be an internet location through which the User may access information carried by Website in the database maintained by it. The term "service" would include the search tools through which the User can search through the hosted databases and information using a number of search tools that are present with a selection matching their search criteria. Users then select one or more of the items presented to view the full document/ record. The term Service does not mean that the Site Owner is acting as an agent either express or implied on behalf of any person. The User hereby agrees to upload only accurate information relating to real estate matters. The User agrees not to set up fictitious properties or upload any matter/information relating to fictitious properties. If the User comes to know of any information on the Website that is fictitious/false or otherwise not in conformity with the Terms of use or otherwise offends the User in any manner, the User agrees to immediately send a complaint to support@hiqker.com enabling the Site Owner to take appropriate action.

The Services provided by the Website also include posting of profiles or listings for the purpose of sale, purchase or rental of any property, and for providing property services.

The User agrees not to submit, use and /or cause the storage into the Website, any information that:
is defamatory, abusive, harassing, threatening, or an invasion of privacy of another person; (b) is bigoted, hateful, or racially or otherwise offensive; (c) is violent, vulgar, obscene, pornographic or otherwise sexually explicit; or (d) otherwise harms any person or entity;

is illegal or encourages or advocates illegal activity or the discussion of illegal activities with the intent to commit them, including a posting or submission that is, or represents an attempt to engage in, child pornography, stalking, sexual assault, fraud, trafficking in obscene or stolen material, drug dealing and/or drug abuse, harassment, theft, or conspiracy to commit any criminal activity;

infringes or violates any right of a third party including: (a) copyright, patent, trademark, trade secret or other proprietary or contractual rights; (b) right of privacy (specifically, the User must not distribute another person's personal information of any kind without the prior written permission of such other person) or publicity; or (c) any confidentiality obligation;

contains a virus or other harmful component, or otherwise tampers with, impairs or damages the Website or any connected network, or otherwise interferes with any person or entity's use or enjoyment of the Website; or

Is antisocial, disruptive, or destructive, including "flaming," "spamming," "flooding," "trolling," and "griefing" as those terms are commonly understood and used on the Internet.

Is not accurate or is otherwise inconsistent with the these terms & conditions.

The User understands and accepts the fact that the Site Owner cannot and does not assure the User that other Users will comply with these Terms or any other provisions of these Terms of Use, and, as between the User and Site Owner, the User hereby assumes all risk of harm or injury resulting from any such lack of compliance.

The User shall not use the Website for in any way that is unlawful, or harms the Site Owner or any other person or entity, The Site Owner's decision with regard to the above use shall be final and binding on the User. Any use of the Website or its related services that amounts to use of the Website's resources or User submissions for the purpose of or has the effect of competing with or displacing the market for the Website content, or its User submissions is prohibited.

The User understands and acknowledges that the User may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable, and the User agrees to waive, and hereby does waive, any legal or equitable rights or remedies the User has or may have against the Site Owner or the Website with respect thereto, and agrees to indemnify and hold Site Owner, its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to the use of the Website by the User.

The User is prohibited from using another User's account without obtaining the prior permission of such other User. The User is solely responsible for the activity that occurs on the User's account, and the User must keep the Users account password secure. The User must notify the Website immediately, in the event of any breach in security or unauthorized use of the Users account. The Site Owner assumes no responsibility for the completeness and/ or availability of information posted/submitted by Registered Users on the Website.

Although the Site Owner will not be liable for the User's losses caused by any unauthorized use of the Users account, the User shall be liable for the losses of the Site Owner or others due to such unauthorized use of the Users Account.

The User agrees not to alter or modify any part of the Website or any of its related technologies. Further, the User shall not:

a) Reverse engineer, decompile, disassemble, copy, reproduce, distribute, modify, transmit, perform, publish or create derivative works from or in any way exploit any part of the Website in violation of the Terms of use or the laws of any country.
b) Create a database in electronic or structured manual form by systematically downloading and storing the entire Website or part thereof except such information as relates or concerns the User.
c) Cache or permit caching by any person.
d) Commit any act that violates the Site Owner's intellectual property rights in the Website.
e) Engage in any fraudulent, abusive or illegal activity, including but not limited to any communication or solicitation designed or intended to fraudulently obtain the password or any private information relating to any other user.
f) Use the Website to violate the security of any computer or computer network, crack passwords or security encryption codes, transfer or store illegal material including threatening or obscene material or engage in any kind of illegal activity.
g) Run a mail list or any form of auto-responder, or spam on the Website or any processes that are run or are activated while the User is not logged on or engage in any virus attack or denial of service, attach or engage in any activity designed and/or intended to interfere with the working of Website for any duration of time.

The User agrees not to use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," that accesses the Website in a manner that sends more request messages to the Website servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser.
Notwithstanding the foregoing, the Site Owner grants the operators of public search engines permission to use spiders to copy materials from the Website for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. The Site Owner reserves the right to revoke these exceptions either generally or in specific cases. The User agrees not to collect or harvest any personally identifiable information, including account names, from the Website, nor to use the communication systems provided by the Website (e.g. comments, email) for any commercial solicitation purposes. The User agrees not to solicit, for commercial purposes, any other Users of the Website.

In the use of the Website, the User shall otherwise comply with these Terms of Use and all applicable local, national, and international laws and regulations.

The Site Owner reserves the right to discontinue any aspect of the Website at any time.

Payment

Where Subscription Fees accrues it shall be payable at or within such time as stated in the invoice(s) issued by the Site Owner to the User. The Subscription Fees shall be paid by the User on demand. In case the user disputes the same for any reason whatsoever, he shall make the payment towards the Subscription Fees accrued till the resolution of the dispute. In the event of Site Owner deciding the dispute in the User's favour, the Company shall refund to the User any excess amount paid by the User free of interest. In case of any delay in the payment by the User of any sums due, the Site Owner shall have the right to charge interest on the outstanding amount from the date the payment became due until the date of final payment by the User.

Account Termination

The Site Owner will terminate a User's access to the Website if the User is determined to be in violation of the Terms of Use or of any applicable law.

The Site Owner reserves the right to decide whether a User Submission is appropriate and is not in violation of these Terms of Use.

The Site Owner may remove any User Submissions and/or terminate a User's access for uploading any material in violation of these Terms of Use, at any time, without prior notice and at the Site Owners sole discretion.

The Site Owner reserves the right to deny, at its sole discretion, any User access to this Website or any portion thereof without notice.
